Introduction

These Terms of Service ("Terms") govern your access to and use of Hey CC's services, including our messaging service, website, and any other services that link to these Terms (collectively, the "Services").

By using our Services, you agree to be bound by these Terms. If you don't agree to these Terms, you may not use our Services.

Using CC

Who Can Use the Services

You must be at least 13 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement.

Registration and Your Account

When you use our Services, you may be asked to provide a phone number for registration. You agree to provide accurate, current, and complete information and to update this information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account, and you are responsible for all activities that occur under your account. You agree to immediately notify CC of any unauthorized use of your account.

User Content

Our Services may allow you to send messages, create content, and share information. You retain ownership of any intellectual property rights that you hold in that content. By submitting or sharing content through our Services, you grant CC a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, modify, analyze, display, and store your content solely for the purposes of operating, developing, providing, and improving our Services.

Rights and Limitations

Your License to Use the Services

Subject to your compliance with these Terms, CC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use.

Acceptable Use Policy

You agree not to misuse our Services. For example, you must not, and must not attempt to:

• Use our Services in a way that violates any applicable law or regulation
• Use our Services to send spam or unsolicited messages
• Engage in abusive behavior towards other users or our staff
• Interfere with the operation of our Services
• Attempt to access areas of our Services that you are not authorized to access
• Engage in any activity that could compromise the security of our Services
• Use our Services to transmit any content that is unlawful, offensive, harassing, or otherwise objectionable

Intellectual Property

The Services and their content, features, and functionality are owned by CC, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any rights to use CC's trademarks, logos, domain names, or other brand features.

Disclaimers and Limitations of Liability

Service "AS IS"

THE SERVICES ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. HEY CC SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that our Services will be secure or error-free or that access to our Services will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEY CC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

IN NO EVENT SHALL HEY CC'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID HEY CC IN THE PAST TWELVE MONTHS.

General Terms

Termination

We may suspend or terminate your access to and use of the Services at our sole discretion, at any time and without notice to you. You may cancel your account at any time by letting us know in the chat or blocking our number.

Upon termination, all rights and licenses granted to you in these Terms will immediately cease.

Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you. By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised Terms.

Governing Law

These Terms and any action related thereto will be governed by the laws of the State of California without regard to its conflict of law provisions.

Entire Agreement

These Terms constitute the entire and exclusive agreement between you and Hey CC regarding the Services, and these Terms supersede and replace any prior agreements between you and Hey CC regarding the Services.

Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in effect.

Messaging Services

CC communicates through iMessage, RCS, or WhatsApp based on your selection. By starting a conversation with CC, you're choosing to receive messages from us. You can stop anytime by blocking our number or asking us in the chat.

• CC may send periodic messages. The frequency of these messages depends on your usage patterns.
• CC and its service providers are not liable for delayed or undelivered messages.
